Notice on Purchase of Digital Products

1. What Are Digital Products?

Digital products available on our platform include:

  • Event tickets (delivered electronically)
  • Digital downloads (music albums, audio files, digital content)
  • Other non-physical digital content

2. Immediate Delivery

All digital products are delivered immediately upon successful payment. You will receive your digital product via email to the address provided during purchase.

3. No Right of Withdrawal

IMPORTANT: By purchasing digital products, you explicitly acknowledge and agree that:

  1. Digital content will be delivered immediately after your purchase is complete
  2. You expressly consent to this immediate delivery
  3. You waive your right of withdrawal that would normally apply to consumer purchases under EU Consumer Rights Directive
  4. Digital products are non-refundable once delivered

This waiver is in accordance with Article 16(m) of the EU Consumer Rights Directive, which excludes digital content delivered immediately with the consumer's prior express consent and acknowledgment of losing the right of withdrawal.

4. What This Means for You

Event Tickets

  • Non-refundable: Once purchased, event tickets cannot be refunded or exchanged
  • Non-transferable: Tickets are typically non-transferable unless otherwise stated
  • Event changes: If we cancel or significantly reschedule an event, you will be offered access to the rescheduled event or alternative arrangements

Digital Downloads

  • No refunds: Downloaded digital content (albums, files) cannot be refunded once delivered to your email
  • Delivery responsibility: You are responsible for ensuring your email address is correct
  • Access: You will receive download instructions or access links via email

5. Your Acknowledgment

By clicking "Purchase" or "Complete Order" for digital products, you confirm that you:

✓ Understand the product is digital and will be delivered immediately
✓ Expressly request immediate delivery
✓ Acknowledge you are waiving your 14-day right of withdrawal
✓ Accept that the purchase is non-refundable

6. Quality and Technical Issues

While you waive your right of withdrawal, you retain all other consumer rights, including:

  • Right to conformity: Digital content must be as described and fit for purpose
  • Right to remedy: If digital content is defective or not as described, you may be entitled to a remedy
  • Technical support: Contact us if you experience technical issues with delivery or access

7. Event Cancellations

If an event is cancelled or significantly rescheduled by Endemit:

  • We will notify ticket holders via email
  • Tickets will remain valid for the rescheduled event date
  • If rescheduling is not possible, alternative arrangements will be communicated

8. Contact for Issues

If you experience problems with:

  • Non-delivery of digital products
  • Technical issues accessing content
  • Defective or non-conforming digital content

This notice applies ONLY to digital products. Physical merchandise and products are subject to the standard 14-day right of withdrawal. See our separate "Right to Withdrawal" document for details on returning physical items.
